My husband was injured in a job related accident 2002. He went though surgury a fusion on his neck. We get workman comp. right now. He has alway tried to work where now he's had to quit. We have attorney on this and all. But the doctor and all told him he needs to apply for social security disability. He has chronic nerve damage, he can't use he left arm without feeling a lot of pain. Doctors say it's going to get worse though the years. He's applied for it once and got turned down. But at that time he was still working some. But, what all that is going on with him, he got charged with a felony, It was over pot. What I'm wondering would that stop he's chance of getting disability. If it isn't can you advise me on where to go from here on this? Thank you, April S.

Hi Mr. Ginsberg, My question is if I have spotty contract labor jobs off and on in between my regular jobs due to many disabling conditions,such as 1099 jobs that were not full time because I have to take many unscheduled breaks during these jobs due to my ailments,how do I properly list these jobs to the SSA when the people on my past applications that helped me left off or didn't answer properly my past work history? I'm very worried about this even though I'm not working now and haven't been for over 5 years,I live with my brother now for 5years and he is supporting me but he is getting tired of doing so! I have until april 4,2011 to submit my third application without affecting my new file date! This is becoming a very complicated mess for me! Do you have any advice or help with this job history issues? Thank You, Sincerly, Robert Couch Jr. P.S. I do think you are a smart and caring,dedicated attorney to do all this to help disabled people!!!!!!!!!!!

Robert, I am not a big fan of part time work while you are waiting for a hearing date. As I noted on a post on one of my blogs about part time work and Social Security disability, many judges believe that if you can perform part time work, you could perform full time work at a slightly easier job. This many not be fair or logical but that is what I see more often than not.
