George Will wrote an interesting editorial at http://wapo.st/ReVWVO and he makes several valid points about the unsustainability of entitlements. From my perspective, I am mostly concerned about consistency and predictability of the process rather than expansion of it because we cannot continue the status quo.

As an attorney for Social secuirty disability claimants in Cincinnati I do know the grid rules if applied appropriately can allow a 50 year old that is capable of sedentary work be found disabled. I can accept moving that age to 55. I have no clue as to what the savings would be. But I would like to see a program that retrains those to be able to make a meaningful wage. I also know that the study was flawed but there is just so much money to go around. Also someone has to come to terms with how long we will be paying disability benefits to veterans for these two wars. The presence of government representatives to oppose claims is ridulous as it just adds more expense. The judges do a good enough job of rendering decisions. In 30 years of practice I have only seen one client get benefits that he should not have . So the system is not abused in my opinion.

Robert, I am not a big fan of part time work while you are waiting for a hearing date. As I noted on a post on one of my blogs about part time work and Social Security disability, many judges believe that if you can perform part time work, you could perform full time work at a slightly easier job. This many not be fair or logical but that is what I see more often than not.

I live in Indiana, in May I was scheduled a Social Security hearing which was postponed and no replacement date yet. I have an attorney which I called about this issue and they said; we understand the frustration please be patient. Well for nearly 3 years I have been waiting for a hearing. Just recently I was granted Medicaid, which I am very grateful for. The judge ruled that I was unable to work due to bipolar issues and that COPD was secondary. I'm 56 years old and losing my home waiting for a hearing date.

Hi Jonathan,

Thank you for the pod cast. I am relived to her about the date of disability. I think I did the right thing by associating the date of shoulder surgery to my DOD. I am one of those who kept thinking I could get better... but things went down hill since 2007. I have been self employed my whole life, earned enough credits to qualify and by tagging the year I had my shoulders redone I think I have all the credits I need. I have a number of things degenerated vertebrae in the neck and back, psoriatic arthritis, ebv or chronic fatigue cytomegalovirus (undiagnosed but evident from test's and blood work). undiagnosed) Psoriasis from auto immune.

Will having the above illness and disabilities and now 55 years old help my case? Being self employed i am pretty sure I will need a lawyer... can you handle my case from where you are?

Many Thanks
Barry

Because I was self employed I know I will probably need a lawyer

Hi Mr. Ginsberg, My question is if I have spotty contract labor jobs off and on in between my regular jobs due to many disabling conditions, such as 1099 jobs that were not full time because I have to take many unscheduled breaks during these jobs due to my ailments, how do I properly list these jobs to the SSA when the people on my past applications that helped me left off or didn't answer properly my past work history? I'm very worried about this even though I'm not working now and haven't been for over 5 years,I live with my brother now for 5years and he is supporting me but he is getting tired of doing so! I have until april 4,2011 to submit my third application without affecting my new file date! This is becoming a very complicated mess for me! Do you have any advice or help with this job history issues? Thank You, Sincerly, Robert Couch Jr. P.S. I do think you are a smart and caring, dedicated attorney to do all this to help disabled people!!!!!!!!!!!

i am a 59 year old female. i have worked as a cna and asst. mngr. in a job that deals with lots of issues and long hours. my son was killed in iraq in june 2009. that night i had many horrifing dreams that i find out later, are pretty much how and what happened. i pretty much knew there was something wrong with me. i went to the va for counsuling and was told to meditate. things went real bad after that. i took a part time care for elderly job. i couldn't remember the meds, timing. i had severe panic and anxiety attacks. i ended up in the er and was sent to a psychitrist. i was diagonosed with full blown ptsd., anxiety and depression. no longer able to work, i filed for ssi and ssd. i was denied on both. reconsideration also denied. i was told to work in plastics. seeing that i can't drive because of disosiation and being 59 and no plastics place around, i decided to go for the hearing. i had to hire an attorney and get social security to tell me wher i worked and what i did from the very beginning. i could not

concentrate or fill out my papers. now i am waiting for my hearing, and have to file bankruptcy, and my husband has left me. has been almost a i year since i applied. i know that is not a long time when it comes to ssd but i need to know wher i can go for help. my lawyer didn't even mention ssi to me after my husband left. my husband said he will keep insurance on me for as long as i need. now i am even more depressed and actually thinking about how i wouldn't be in this position if i wasn't here.
